INDIAN TRIBAL COURT
SUPPLEMENTAL COURT RULE 2000-1 – February 11, 2000
PROCEDURES FOR FILING DOCUMENTS WITH
THE COQUILE INDIAN TRIBAL COURT
This supplemental court rule supercedes Supplemental Court Rule 1999-3- November 18, 1999.
1.
Procedure for filing documents during regular judicial days.
A. The document shall include the signature of the person filing the documents, and shall comply in all other respects with the Coquille Rules of Civil Procedure or other applicable rule or ordinance.
B. The party filing the document shall deliver the complete, original document to the court clerk, who will file stamp it, indicating the date and time of filing. Regular judicial days shall be determined by Order of the Chief Judge, which shall be posted outside the clerk’s office and outside the Tribal Courtroom. Copies of the Order Establishing Regular Judicial Days may be obtained form the Court Clerk.
2. Procedures for filing documents at times other than regular judicial days.
A. The document shall include the signature of the person filing documents, and shall comply in all other respects with the Coquille Rules of Civil Procedure or other applicable rule or ordinance.
B. The party filing the document shall call the Bend, Oregon office of the Chief Judge at (541) 330-5092 and leave a message that a filing by fax is to occur.
C. The party shall fax the complete, original document to the Chief Judge at his Bend, Oregon office, fax number (541) 330-5093. The fax transmission shall have a fax heading with the date and time shown, and shall include a cover sheet showing the name, address and telephone number of the faxing party, the total number of pages being faxed, and the date and time of the fax transmission.
D. The filing party shall file the complete, original document with the Court Clerk on the next regular judicial day. The Court clerk will file stamp the original showing the date and time it is personally filed and the date and time of the fax filing, which information shall be provided by the Bend office of the Chief Judge.
E. Upon completion of these procedures, the filing shall be deemed effective as of the date and time of the fax filing. In no event shall personal filing take place more than five (5) calendar days after the date of the fax filing, except as ordered by the Chief Judge.
3. Procedures for filing documents in open court.
An original document may be filed with the court clerk or with the judge in court during a court session convened by the judge.
4. Exclusivity of filing procedures.
The above procedures are the only procedures for filing of documents in the court. Documents which come to the court by any other means shall not be deemed filed, and may be returned to the party or destroyed, at the court’s discretion.
