(1) Maintaining effective and efficient administration and exercising
overall direction and control of the operational affairs of Tribal programs
and departments as assigned by Tribal Council. Such oversight and control
includes, but is not limited to:
(1) Determining operational priorities and carrying out short and
long-term planning and program development as established by the Tribal
Council;
(2)
Determining the organizational structure and positions necessary
to carry out assigned functions and responsibilities most effectively;
(3)
Hiring, training, promoting, assigning, disciplining and discharging
employees in accordance with Tribal laws;
(4)
Delegating responsibility and authority (and accountability for
delegations) to department heads and/ or supervisors as he/ she
deems necessary and appropriate to carry out assigned functions
or Tribal business;
(5)
Authorizing the expenditure of funds consistent with the adopted
Tribal budget; and
(6)
Ensuring appropriate use of Tribal assets and resources.
(2) Representing
the Tribe by name and title and negotiating, executing and administering
agreements and contracts as authorized or delegated by Tribal Council;
(3)
Implementing, by regulation or policy, all legislative actions of
the Council, (except those directly involving Tribal Council procedures
or for which responsibility has been delegated by the Tribal Council
to another official of the Tribe), and establishing such regulations
or policies as are necessary to effectively carry out the business
of the Tribe;
(4)
Reviewing Tribal policies on a regular basis and recommending additions
and changes to the Tribal Council;
(5)
Monitoring and reporting on internal and external matters, including
the provision of services by other governments, that impact the Tribe;
(6)
Overseeing and monitoring all subordinate boards, committees, enterprises
and cooperative associations of the Tribe and reporting to the Tribal
Council on their activities or matters of concern related to such
organizations; and
(7)
Publishing an Organizational Structure of the Tribe at the beginning
of each calendar year and at such other times as material changes
in the structure shall occur, provided that the Organization Structure
shall first be reviewed and approved by the Tribal Council. The Organization
Structure shall include the names of all work units, key positions,
number of authorized positions for each unit, delegated functions
and responsibilities to be carried on by each unit and the lines of
authority and accountability. The Organizational Structure shall be
drafted according to the following organization goals:
(1) Focusing resources on direct delivery of services, and avoiding
unnecessary layers of administration or management.
(2)
Responding to the people served and clear lines of accountability
and responsibility.
(3)
Active, effective, and efficient processing of decisions, authorizations,
transactions and services.
(4)
Efficient use of human and financial resources, integrate programs
and services, with effective coordination and avoidance of duplication.
