Proposed Nanitch Sahallie Advisory Board Ordinance

Tribal Code § 8.40


(a) PURPOSE AND AUTHORITY:
The purpose of this ordinance is to establish an Intertribal Advisory Board to advise the Tribal Council in the policy making for the Nanitch Sahallie Youth Primary Residential Treatment Program. The Confederated Tribes of the Grand Ronde Community of Oregon wish the Board to serve as a link between the Oregon Indian communities and the Grand Ronde Tribal Council and Nanitch Sahallie Program. The authority is Article III, Section I, of the Constitution of the Confederated Tribes of the Grand Ronde Community of Oregon.


(b) DEFINITIONS:

(1) "Board" means the Intertribal Advisory Board to the Nanitch Sahallie Youth Primary Residential Treatment Program, comprised of one member from each of the nine (9) federally recognized Oregon Tribes and one member for the Chemawa Indian School Board.

(2) "Oregon Tribes" means the nine (9) federally recognized Oregon tribes, including Burns-Paiute Tribe, Confederated Tribes of Coos, Lower Umpqua and Siuslaw, Confederated Tribes of the Grand Ronde Community of Oregon, Confederated Tribes of Siletz Indians, Confederated Tribe of the Umatilla Reservation, Confederated Tribes of the Warm Springs Reservation, the Coquille Tribe, the Cow-Creek Tribe of Umpqua Indians, and the Klamath Indian Tribe.

(3) "Tribe" means the Confederated Tribes of the Grand Ronde Community of Oregon.

(4) "Director" means the Director of the Nanitch Sahallie Youth Primary Residential Treatment Program.

(5) "Nanitch Sahallie" means the Nanitch Sahallie Youth Primary Residential Treatment Program.

(6) "Tribal Council" means the Tribal Council of the Confederated Tribes of the Grand Ronde Community of Oregon.


(c) MEMBERSHIP OF THE BOARD:

(1) General Provisions

(A) The Tribe seeks advice and assistance from all of the Oregon Tribes and the Chemawa Indian School regarding policy concerning Nanitch Sahallie. The Tribe has set up this Board to obtain the combined wisdom and experience of the Oregon Tribes in combating alcohol and drug abuse among our youth.

(B) The membership of the Board shall be constituted of one (1) representative from each of the Oregon Tribes and one representative from the Chemawa Indian School.

(C) Each representative will be recommended in a manner determined by his or her governing body. Upon consideration of recommendations from each Oregon tribe and the Chemawa Indian School, the Tribal Council shall appoint each representative.

(D) Each tribal governing body and the Chemawa School Board shall also recommend an alternate for their respective representative. Upon consideration of these recommendations, the Tribal Council shall appoint such alternates. The alternate should attend those meetings of the Advisory Board that the regular representative is unable to attend. Alternates must meet the same basic requirements for representatives as set out elsewhere in this section. When an alternate acts in the capacity of a Board member, the alternate shall be entitled to the same reimbursements set out below for Board members.

(E) Each representative should have a demonstrated interest in, knowledge of and/or experience in alcohol/drug services.

(F) The term for each representative shall be two years.

(G) The Tribe will reimburse each Board member for non-reimbursed expenses and compensation at the Tribal rate, according to Tribal policy regarding committee member travel.

(H) If a Board member has three (3) consecutive unexcused absences from meetings of the Advisory Board, that member may be removed from the Board by the Tribal Council. The Tribe whom that member represents, or the Chemawa Indian School if it is the Chemawa representative, shall recommend a new candidate for consideration by the Tribal Council, who shall appoint a new Board Member to complete the term of the Board Member who was removed.

(2) Selection of Grand Ronde Member

(A) The general provisions apply to the selection of the Grand Ronde member of the Board.

(B) The Tribal Council will select the Board member with the advice of the Health and Human Services Committee.

(C) The Grand Ronde Member must have the following qualifications:

1. Enrolled membership in the Tribe;

2. Over twenty-one (21) years of age;

3. Knowledge of and experience in alcohol/drug services;

4. No felony convictions within the last two (2) years;

5. Has been alcohol/drug abuse free for the past two (2) years.


(d) DUTIES:

(1) Advise the Tribal Council in policy direction of Nanitch Sahallie including administrative services and clinical services.

(2) Serve as a liaison between the Oregon Tribes and Nanitch Sahallie and as a liaison among the Oregon Tribes regarding Nanitch Sahallie.

(3) Represent the desires and interests of the Oregon Tribes and the Native American population of the Northwest, from which Nanitch Sahallie accepts its clients, in securing and maintaining a high-quality program and components at Nanitch Sahallie.

(4) Promote the prevention, rehabilitation and treatment of alcohol and drug abuse in the Native American population of the Northwest through the program and components operating at Nanitch Sahallie.


(e) MEETINGS:

(1) Meetings of the Board will be held quarterly.

(2) Four (4) Board members shall constitute a quorum.

(3) The Board shall select from among its members a Chair, Vice-Chair and Secretary.

A. The Chair shall be a member of the Tribe.

B. No individual shall serve as Chair for more than 2 consecutive terms.

(4) Special meetings may be held to deal with matters that, due to their urgency, need to be decided upon before the next scheduled meeting. Only the Board Chair or four (4) Board members may call a special meeting.

(5) Location of meetings: the Board shall meet at Nanitch Sahallie unless circumstances prevent meeting there.
