CHAPTER 26
EDUCATION CODE
OF THE OGLALA SIOUX TRIBE
Purpose & Intent:
It is the purpose and intent of the Oglala Sioux Tribe to establish a Tribal Education Code as authorized under the authority of P.L. 95-561. To provide Oglala Sioux with "quality education opportunities from early childhood through life in accordance with the Tribe's needs..." and ensure the Tribes right to "fully exercise self-determination and control in planning, priority setting, development, management, operation, staffing and evaluation in All aspects of the education process".1
This CODE is designed to establish educational guidelines for use as minimum guides for educational standards for All school systems on the Pine Ridge Indian Reservation .
The research and development of this CODE began in 1979 with the establishment, by Council Resolution, of an Oglala Sioux Tribal Education Task Force. This Task Force identified and prioritized educational issues and concerns of the Pine Ridge Indian Reservation. Our staff continued to collect data through direct participation, on-going research, and consultation with educators of varying degrees.
"On January 4, 1975, the Indian Self-Determination and Education Assistance Act, Public Law 93-638, was approved. In enacting this legislation, the Congress declared its commitment to maintain the Federal Government's continuing relation with and responsibility to Indian through establishment of a meaningful Indian self-determination policy. This was to permit an orderly transition from federal domination of programs for Indians to more effective and meaningful participation by Indians in planning, conducting, and administering programs and services provided by B IA."2
The Education Commission of the States Task Force statements on Indian education stated herein recognize the federal trust responsibility established by the Congress of the United States through treaties made with Indian nations, legislation and court decisions. These precedents emphasize Indian sovereignty, Indian self-determination, and full involvement of the Indian communities at the local, state and national level in the establishment of educational policy for Indian citizens."3
"The Education Commission of the States Task Force also recognizes that the states have the primary responsibility to educate all Indian children and adults while the federal and tribal responsibility is to meet the unique educational and cultural needs of Indian students and adults."3
"It is further recognized that a cooperative effort between all groups concerned, regarding policy making and funding, must be implemented to achieve the full intent of this report - improved education for Indian people."3

Section I. DECLARATION OF POLICY:
The Oglala Sioux Tribe finds that more adequate education is needed on the Pine Ridge Reservation. Therefore, pursuant to the policy of the State of South Dakota and the United States Government to ensure equal education opportunities to every individual the Oglala Sioux Tribal Code of Education shall be designed to:
1. Provide positive reinforcement of the self-image of students, and to recognize and enhance their cultural heritage.
2. Develop curricular programs designed to meet the needs of all students while providing opportunities for students to become proficient in the basic skills necessary to function in a non-Indian or Indian society.
3. Encourage development of teacher training; teacher certification and preparation and awareness to improve the delivery of educational services to students
Section II. ADMINISTRATION:
200.01 Tribal Education Philosophy;
The Oglala Sioux Tribe will adopt a written Education Philosophy stating the
purpose and intent of the Education Department of the Tribe.
200.02 By-Laws and Constitution;
The preparation of a document which states the overall structure of the Oglala
Sioux Tribal Education Department.
200.03 Line of Authority;
The Oglala Sioux Tribal Education Department line of authority chart.
200.04 Code of Ethics;
The Oglala Sioux Tribal Education Department will establish a Code of Ethics for
its personnel regarding professional standards.
200.05 Personnel Policies and Procedures;
The Oglala Sioux Tribal Education Department will develop a Personnel Policies

Section II. TRIBAL EDUCATION PHILOSOPHY
200.0l STANDARD
The Oglala Sioux Tribal Education Department will formulate and document a written Educational Philosophy which states the overall purpose and mission of the Oglala Sioux Tribal Education Department in their development and implementation of educational programs for Indian students on the reservation.
(a) The Philosophy will indicate the significance of education for youth.
(b) The Philosophy will indicate the expected educational outcome for students attending any school system on the reservation.
(c) The Philosophy will indicate those resources which will be provided by the Oglala Sioux Tribal Education Department and school boards for the development and implementation of the educational programs for all school systems on the reservation.
(d) The Philosophy will indicate the significance of Tribal policy in terms of "Tribal Sovereignty" and the jurisdiction over school systems within the reservation.
Section II. BY-LAWS AND CONSTITUTION
200.02 STANDARD:
The Oglala Sioux Tribal Education Department will adopt a By-Laws and
Constitution which states the overall structure and authorities of the
department, in accordance with the Oglala Sioux Tribe ordinances governing
By-Laws and Constitution documents, and subject to restriction or limitations as
imposed by the Constitution of the Oglala Sioux Tribe or the Constitution of the
United States Government.
Section II. LINE OF AUTHORITY
200.03 STANDARD:
The Oglala Sioux Tribal. Education Department will establish and document a line
of authority chart for purposes of identifying overall organizational
responsibilities for communication, problem- solving, policy development and
decision making.
Section II. CODE OF ETHICS
200.04 STANDARD:
The Oglala Sioux Tribal Education Department will establish a Code of Ethics for
personnel employed in the department, with such Code of Ethics to be viewed as
policy in the performance of personnel duties within the department. This Code
will provide expectations as to: support of co-workers, support of the Tribe,
obligations to the community, obligations to the student, obligations to co-
workers and obligations to the Education Department.
200.04-1 STANDARDS:
Professional Code of Ethics as outlined in the school policies manual should be
followed. Policy for handling any type of deviance from that Code established as
a breech of professional conduct shall be documented in the Oglala Sioux Tribal
Education Department Policies and Procedures Handbook. (200.05)
Section II PERSONNEL POLICIES AND PROCEDURES
200.05 STANDARD:
The Oglala Sioux Tribal Education Department will approve and disseminate a
Personnel Policies and Procedures Handbook to all personnel providing a function
within the department as an employee, with such document to provide personnel
information on established processes and procedures for effective management of
the department and expectations of personnel in the performance of their duties.
Section II FISCAL AND ACCOUNTING PROCESS
200.06 STANDARD:
The Oglala Sioux Tribal Education Department will develop, and implement a
fiscal accounting process to meet the fiscal and accountability expectations of
the department and any funding agencies . The fiscal and accounting processes
established by the department will be in accordance with existing Tribal, State
and Federal regulations and ordinances concerning fiscal accountability.
Certification of fiscal and accounting process for the department by a licensed
accounting agency, will be disseminated to the appropriate agencies .
Section II GRIEVANCE PROCEDURE
200.07 STANDARD:
The Oglala Sioux Tribal Education Department will approve personnel grievance
procedures to govern personnel under the department.
Section II POLICY DEVELOPMENT PROCESS
200.08 STANDARD:
The Oglala Sioux Tribal Education Department will approve and implement a policy
development process for the development and approval of any policy created for
the department .
Section II POLICY REVIEW AND EVALUATION
200.09 STANDARD:
The Oglala Sioux Tribal Education Department will implement a program evaluation
and review process for all department programs and schools . The programs and
schools will be reviewed and evaluated a minimum of twice during the year with
administrators to make changes or recommendations of enforcement.
Section II PERSONNEL EVALUATION
200.10 STANDARD:
The Oglala Sioux Tribal Education Department will approve and implement a
personnel evaluation process for all department employees within their
department, with support personnel being evaluated a minimum of twice during the
program year . Administrators being evaluated a minimum of once during the year,
and other personnel to be evaluated a minimum of twice annually.
Section II COMPREHENSIVE EDUCATION PLAN
200.11 STANDARD:
The Oglala Sioux Tribal Education Department will approve a Comprehensive
Educational Plan for the department, to be reviewed, revised and evaluated
annually, with such plan indicating measurable short-term and long-range goals
and activities designed to provide development in (1) leadership (2) Community
involvement (3) School climate (4) Staff morale (5) Curriculum Development and
(6) Structure.
Section II. MANAGEMENT PROCESS
200.12 STANDARD:
The Oglala Sioux Tribal Education Department will define a management process
which will be functional within the department. The management process will
identify duties and roles of administrative personnel.
Section II. COMMUNITY INVOLVEMENT
200.13 STANDARD:
The Oglala Sioux Tribal Education Department will review policies relating to
(1) use of local resources in the schools (2) use of local facilities by the
community (3) role of the community in the evaluation of the educational program
(4) involvement of the local community in the development policy, programs and
activities of the local schools (5) School and Community activities (6) local
committees established by the department to provide input on activities and (7)
other community involvement policies as determined by the schools and the
community.
Section II. INSERVICE TRAINING
200.14 STANDARD:
The Oglala Sioux Tribal Education Department will provide for an inservice
training program for staff each year, with a minimum of (2) days during the
regular term annually to be utilized for the purposes of staff development and
inservice training. The department will implement a process that will allow
staff input in determining inservice annually; the department will allocate
funding annually for the delivery of inservice training from available funding.
Section II. EMPLOYMENT CONTRACTS
200.15 STANDARD:
The Oglala Sioux Tribal Education Department will develop, approve and enforce
policy governing the issuance, renewal, non-renewal, termination, salary rates
and contract timelines for Administrative, Support and other position contracts
for all personnel positions in the department; the department will develop
contract formats to be utilized for all personnel positions in the department;
original copies of contracts to be given to individual employees.
Section II. DISASTER PLAN
200.16 STANDARD:
The Oglala Sioux Tribal Education Department will approve a Disaster Plan for
the Education Department building to all staff at the beginning of each year;
emergency exit processes and pathways will be posted in each office and other
facility areas of the building.

200.17 STANDARD:
The Oglala Sioux Tribal Education Department will approve a department Policy
Manual which shall incorporate all fiscal, educational, support service,
personnel, facility, transportation, student and other policies provided for
within the Oglala Sioux Tribal Education Department.
Section II. ACCREDITATION
200.18 STANDARD:
The Oglala Sioux Tribal Education Department shall utilize structural,
administrative, program, personnel, and other departmental element
recommendations and processes required by North Central or other identified
nationally-recognized accrediting agency standards to insure continued Oglala
Sioux Tribal Education Department evaluation and development, and to receive
recognition as the official accrediting agency for school systems on the Pine
Ridge Reservation.

South Dakota Codified Laws Professional Practices and Standards Commission Code
of Ethics should be followed, and viewed by the local school system as policy in
the performance of professional services.

300.05 STANDARD:
The local school board will document and disseminate a Personnel Policies and
Procedures Handbook to all personnel providing a function within the school
system as an employee, with such document to provide personnel information on
established processes and procedures for effective management of the school
system, and expectations of personnel in the performance of their duties.
Section III. STUDENT RIGHTS AND RESPONSIBILITIES HANDBOOK
300.06 STANDARD:
The local school board will direct development and disseminate a local school
system Student Rights and Responsibilities Handbook for students which meets
existing federal requirements.
300.06-1 STANDARD:
The Oglala Sioux Tribal Education Department will review policies developed by
the school board. (Reference 500.02-1)
Section III. FISCAL AND ACCOUNTING PROCESS
300.07 STANDARD:
The local school board will develop, document and implement a fiscal and
accounting process to meet the fiscal accountability expectations of the school
system, funding agencies and other resources.
300.07-1 STANDARD:
The local school system shall conduct an annual audit of all funds acquired by
the local school system during each fiscal term as established by the local
school system, with certified reporting of audit results to be submitted to the
Oglala Sioux Tribal Education Department following review by the local school
system (to be submitted within 90 days following the end of the identified
fiscal term).
Section III. SCHOOL DAY
300.08 STANDARD:
The local school board will establish and disseminate information on the school
day as designated by the local school system, with each school day consisting of
a minimum of five and one-half hours exclusive of intermissions for a 175-day
calendar, or as required by regulations.
Section III. SCHOOL CALENDAR
300.09 STANDARD:
The local school board will develop and disseminate a proposed School Calendar
by March of the preceding school term for the ensuing school term, with such
calendar indicating days in session, days of legal discontinuance, and other
appropriate information, with the length~of the total school term, excluding
days of legal discontinuance, providing for a minimum of 175 days in session for
student instruction for a 5-day/week schedule, or 962.5 total hours for student
instruction.
300.09-1 STANDARD:
The local school board will declare days of legal discontinuance.
300.09-2 STANDARD:
School shall be discontinued on the following days in the event that the day
occurs on a regular school day; Memorial Day, July 4, December 25, Labor Day,
Veterans Day, Good Friday, Thanksgiving Day, Friday following Thanksgiving, New
Years Day, SDIEA and SDEA.
Section III. GRIEVANCE PROCEDURE
300.10 STANDARD:
The local school board will establish personnel grievance procedures based on
due process and in accordance with regulations established by school boards and
reviewed by the Oglala Sioux Tribe Education Department.
300.10-1 STANDARD:
Grievance procedures shall follow the following pattern;
Informal; Handled by immediate supervisor.
Formal; Filed in writing through established line authority of local system.
Section III. POLICY DEVELOPMENT PROCESS
300.11 STANDARD:
The local school board will direct the development and implementation of school
policy and approval of any school system, in accordance with Tribal, State or
Federal regulations.
Section III. PERSONNEL EVALUATION
300.12 STANDARD:
The local board will develop and disseminate a personnel evaluation process for
all school employees within their school system, with instructional personnel
being evaluated a minimum of twice during the regular school term,
administrators being evaluated a minimum of once during the regular school term,
and other personnel to be evaluated a minimum of twice annually; the local
school board will develop and disseminate to personnel a philosophy and process
for evaluation of all personnel in the school system.

300.13 STANDARD:
The local school board will direct the development of a Comprehensive
Educational Plan for their school system, to be reviewed, revised and evaluated

community sponsored activities {6) local committees established by the school
board to provide input on activities and (7) other community involvement
policies as determined by the local school board and the community.
Section III. PARENT ADVISORY COUNCIL
300.16 STANDARD:
Local school boards may establish parent advisory councils to effectively
express their views and participate in the school system.
Section III. IN-SERVICE TRAINING
300.17 STANDARD:
The local school board will provide for an in-service training program for
school staff each year, with a minimum of (2) days during the regular school
term each year to be utilized for the purposes of staff development and
in-service training. The local school board will implement a process that will
allow staff input in determining in-service annually; the local school board
will allocate funding annually for the delivery of in-service training from
available funding.
Section III. STAFF ORIENTATION
300.18 STANDARD:
The local school board will provide for a minimum of a 2-day preservice
orientation for all new staff immediately preceding the beginning of each school
term, with such orientation to provide staff with information on policies,
procedures, expectations, roles, resources, processes and other appropriate
information activities.
Section III. CONTRACTS/EXTRA-DUTY CONTRACTS
300.19 STANDARD:
The local school board will develop, disseminate and enforce policy governing
the issuance, renewal, non-renewal, termination, salary rates and contract
timelines for Administrative, Teacher and other personnel position contracts for
all personnel positions in the local school system.
300.19-1 STANDARD:
The local school board will establish policies for extra-duty contracts for
personnel. Such contracts shall list roles, duties and responsibilities.
Section III. DISASTER PLAN
300.20 STANDARD:
The local school board will direct development and disseminate a Disaster Plan
for their school building to all staff at the beginning of each school term;
emergency exit and pathways will be posted in each office, classroom and other
areas of the school; fire drills will be conducted monthly under the supervision
of and evaluation by the school Administrator, with a written report of each
practice drill being submitted to the local school board.
Section III. SCHOOL BOARD POLICY MANUAL
300.21 STANDARD:
The local school board shall direct the development and disseminate a School
Board Policy Manual which shall incorporate all fiscal, educational, support
service, personnel, facility, transportation, student and other policies
provided for within the school system.

Section IV. PERSONNEL:
400.01 Administration
School administrative personnel will be required to possess certificates and
professional endorsements as required by Tribal and State Law.
400.02 Teacher Certification
Local school board will employ education personnel certified by Tribal and State
Law.
400.03 Limited Endorsements
Local school board shall request limited endorsement certificates.
400.04 Personnel Selection Process
Process in which the local school board provides for selection of employees.
400.05 Personnel Job Descriptions
Job descriptions and review procedures.
400.06 Personnel Records
Records must be maintained on all employees employed by the local school system.
400.07 Physical Examination
All personnel will be required to participate in a physical examination at the
time of employment.
400.08 Supervision
Policies regarding personnel supervision of students.
Section IV. ADMINISTRATION
400.01 STANDARD:
The local school board shall select those administrative personnel required to
provide effective direction for school staff and consistent administration of
school board policies.
Administrative personnel shall meet professional qualification and endorsement requirements as established by the Oglala Sioux Tribal Education Department for identified administrative positions as listed in the Oglala Sioux Tribal Education Code prior to selection by the local school board.
400.01-1 STANDARD: Superintendent:
The Superintendent endorsement will require;
(a) Elementary or Secondary Teacher Certificate.
(b) minimum of (2) years teaching experience at the elementary level, with appropriate level of teaching endorsement, with an additional (1) year of experience in working in an elementary or secondary school.
(c) completion of an approved program for Superintendents at a college. (Advanced Professional Degree - Education)
400.01-2 STANDARD: Elementary Principal:
The endorsement as Elementary Principal will require;
(a) Junior High School Teacher endorsement.
(b) minimum of (2) years teaching experience in an elementary or Secondary Teacher Certificate.
(c) completion of an approved Elementary Principal or Secondary Principal program through an approved college with a minimum of a Master's Degree completed.
400.01-3 STANDARD: Junior High/Senior High School Principal:
The endorsement as Junior High/High School Principal will require;
(a) Senior High/High School Teacher Endorsement.
(b) minimum of (2) years teaching experience in a Junior High or Senior High School, with an approved Secondary Teacher Certificate.
(c) completion of an .approved Secondary Principal program through an approved college, with a minimum of a Master's Degree completed.
400.01-4 STANDARD: Assistant Principal:
Persons assigned as an Assistant Principal shall meet those endorsement requirements as prescribed for the Principal to the grade level assigned as Assistant Principal.
Section IV. TEACHER CERTIFICATION
400.02 STANDARD:
The local school board will employ education personnel who meet certification requirements of Tribal and State Law and those additional requirements of the local school board.
Instructional staff will be assigned to areas of responsibility in which they hold a major or minor degree.
The Oglala Sioux Tribal Education Department will review teacher qualifications and certificates for teaching.
The local school board will require the acquisition of special skills certification for instructional staff in areas of Lakota culture.
The local school board will employ coaching personnel meeting certification requirements of Tribal and State Law.
The local school board will employ teachers who have a minimum of (3) semester hours of credit in Lakota Language or Lakota Culture. This requirement may be waived upon verification of enrollment in a Lakota Language or Lakota Culture course.
Teachers must participate in Lakota Language or Lakota Culture courses on an annual basis until a minimum of (9) credit hours is acquired, with a minimum completion of (3) hours annually.
400.02-1 STANDARD: Pre-school Teacher:
Headstart and other Pre-School Program teachers will be issued a Pre-School
Teacher Certificate upon submission of an application for certification, and
upon completion of the following minimum requirements:
(a) Associate of Arts Degree in a field directly relating to teaching and instruction.
(b) Verification of enrollment in continuing education, with a minimum expectation of (9) credit hours of college course work.
The Pre-School Teacher Certificate shall be valid for a period of two years, with renewal of the certificate endorsement to be authorized upon verification of a minimum of (18) credit hours of college course work having direct application to teaching and instruction, or requirements for a B.S. Education program.
This requirement may be waived upon verification of enrollment in an approved Associate of Art program. A minimum of (6) credit hours of study must be completed per regular session.
400.02-2 STANDARD: Elementary Teacher:
The Elementary Teacher Certificate will be authorized and issued to those
individuals having completed the following minimum requirements:
(a) Bachelor of Science in Education degree from an approved teacher preparation institution, with specific course work in Educational Psychology, Methods (Language Arts, Social Studies, Science, Math, Reading), Music, Art, Speech, Arts and Crafts, Composition, Physical Science, Biological Science, American History, Indian Studies and Physical Ed.
(b) Completion of a minimum of (9) hours in Bilingual or Bicultural Education, with such requirements waived on verification of enrollment in a minimum of (6) credit hours during that time of which the certificate is valid.
(c) The Elementary Teacher Certificate will be issued for a period of 5 years, with renewal of the certificate based on meeting those expectations as listed in (b) if not previously completed, and completion of a minimum of (9) credit hours of college course work applicable to elementary education, or other degree program.
The Elementary Teacher Certificate endorsement will authorize the individual to provide instruction at the K-9 grade levels.
400.02-3 STANDARD: Junior High School Teacher:
Persons assigned as a Junior High Teacher shall meet those endorsements and
educational requirements of either the Elementary teacher or Senior High
teacher, providing that the structure of the Junior High includes either grades
7-8, or grades 6-8 or 7-9 in a formally-organized middle school.
400.02-4 STANDARD: Senior High School Teacher:
The Senior High School Teacher Certificate will be authorized and issued to
those individuals having completed the following minimum requirements:
(a) Bachelor of Science in Secondary Education degree from an approved teacher preparation institution.
(b) Assignment of endorsement and identification of approved teaching areas will be based upon the following:
1. Teacher will be allowed to teach in undergraduate major field of study, providing a minimum preparation of (30) hours of coursework completed in the major field of study in verified on the undergraduate transcript.
2. Teacher will be allowed to teach in undergraduate minor field of study, provided that a minimum of (20) hours of coursework completed in the minor field of study is verified on the undergraduate transcript.
(c) Completion of a minimum of (9) hours in Bilingual of Bicultural Education, with such requirement waived upon verification of enrollment in a minimum of (6) credit hours of such coursework during the first school term for which the certificate has been issued.
(d) B.S. Degree program to include Secondary methods, Educational Psychology, Reading in the Secondary School, Indian-Studies (3), Education electives (6).
400.02-5 STANDARD: Substitute Teacher:
Authority to function as a Substitute Teacher will be granted to those
individuals functioning as a substitute teacher in the absence of the regular
teacher, with such certificate being valid for (30) substitute days, upon
application and verification of the following:
(a) minimum of a high school diploma or GED certificate.
(b) completion of application form for Authority to function as a Substitute Teacher, and submission to the certification department.
Applicants issued any Substitute Teacher certificate following the initial (30) day application, must re-submit an application form for re-certification, and verification of:
(a) completion of a minimum of (6) credit hours of college coursework, or enrollment in courses at the time of application.
(b) no certification will be granted re-issuance should item (a) not be completed.
400.02-6 STANDARD: Special Education Teacher:
The Special Education Teacher endorsement will require; (a) minimum of a B.S.
degree in elementary or secondary education.
(b) endorsement as either an elementary or secondary teacher.
(c) completion of an approved program in one or more areas of Special Education at a college.
400.02-7 STANDARD: Counselor: The Counselor endorsement shall require:
(a) minimum of B.S. degree in elementary or secondary education.
(b) Elementary, Junior High, or Senior High School certificate.
(c) completion of an approved Counselor preparation program at a college, with a minimum of a Master's Degree in Counseling completed.
400.02-8 STANDARD: Athletic Coach:
The Athletic Coach endorsement for any coaching activity K-12 will require:
(a) minimum of B.S. Elementary or Secondary Education degree.
(b) minimum undergraduate preparation of (18) hours in P.E. related coursework, to include: methods of coaching, First Aid and Injury .pa
Prevention, Anatomy and Kinesiology, Physical Conditioning, and specific methods course in activity to be coached.
400.02-9 STANDARD: School Nurse:
The School Nurse endorsement shall require licensure as a Registered Nurse or
Licensed Practical Nurse.
400.02-10 STANDARD: Teacher Aide Certificate:
Teacher Aide certificate will be applied for and authorized on an annual basis,
with the following minimum requirements:
(a) completion of a minimum of (30) credit hours of college coursework.
(b) Advanced Teacher Aid Certificate will be authorized for issuance to those individuals having successfully completed an A.A. Degree through a recognized post-secondary institution.
Teacher Aide certification renewal will be applied for an authorized on an annual basis, with the following minimum requirements:
(a) verification of completion of a minimum of (12) credit hours of college coursework applicable to developing. effectiveness as a classroom aide since the most recent application for Teacher Aid Certification.
Temporary Teacher Aide certification will be applied for authorized upon meeting the following minimum requirements:
(a) completion of a minimum of (20) credit hours of college coursework, with enrollment in a minimum of (6) credit hours of college coursework during that time in which the Temporary certification is valid.
(b) Temporary certificates will be authorized for 6 months, with renewal dependent upon completion of courses participated in during the temporary certification term.
Section IV. LIMITED ENDORSEMENTS
400.03 STANDARD:
Limited endorsements shall be issued to educational personnel for a period of
(1) year, upon request from the local school board, with such request requiring
a minimum of:
(a) the person for whom the request is submitted will verify enrollment in a minimum of (9) credit hours of college coursework to be completed prior to the issuance of any additional limited endorsement, and with such coursework to apply directly to the position in which the person will be functioning in the school system.
Limited certificates will be issued only to those individuals needing elementary or secondary endorsements.
The local school board will verify in their respect for limited endorsement for an individual an attempt to acquire personnel meeting certification requirements for each position.
Section IV. PERSONNEL SELECTION PROCESSES
400.04 STANDARD:
The local school board will develop and implement a personnel selection process
designed to acquire qualified personnel for employment within the school system.
Section IV. PERSONNEL JOB DESCRIPTIONS
400.05 STANDARD:
The local school board will provide for the development and dissemination of job
descriptions for all personnel. The job description will be reviewed with
employees at the time of employment.
Section IV. PERSONNEL RECORDS
400.06 STANDARD:
The local school board will provide for a personnel records system for all
employed by the school system. Policies governing access to and use of
information contained in personnel folders will be developed to ensure
confidentiality of all personnel records.
Section IV. PHYSICAL EXAMINATION
400.07 STANDARD:
The local school board will require all personnel in the school system to
participate in annual Tuberculin testing. All personnel will be required to take
a physical examination annually prior to the beginning of the school term.
Section IV. SUPERVISION
400.08 STANDARD:
The school board or designated administrative personnel will develop policies regarding the duties and responsibilities of personnel providing supervision of student in on-campus and extracurricular activities. The school board or designated administrative personnel will provide an orientation as to the duties and responsibilities of those personnel providing supervision for students. '

500.01-1 STANDARD:
The Pre-School program hall provide children with a learning environment which
will enhance development socially, intellectually, physically and emotionally in
a manner appropriate to their age and level of development.
Section V. ELEMENTARY EDUCATION PROGRAM
500.02 STANDARD:
Each elementary program will have a written curriculum in scope and sequence in
all learning areas.
500.02-1 STANDARD:
Schools shall incorporate the following learning areas into their Elementary Education Program:
(a) Communication/Language Arts, reading, speaking, writing, listening, spelling, Lakota Language.
(b) Mathematics, numbers, numeration, number facts, arithmetic higher level functions, applications to problem solving, symbols and symbol literacy, language and logic.
(c) Science, life, physical, earth.
(d) Social Science, geography, history, citizenship, Tribal Government.
(e) Fine Arts, Music, art, creative dramatics, Lakota Culture.
(f) Applied Arts, crafts career awareness, consumer education.
(g) Physical Education/Health.
NOTE: ORDINANCE establishing a five (5) day school week for all elementary and secondary schools operating within the exterior boundaries of the Pine Ridge Indian Reservation, and
FURTHER ORDAINED that this Ordinance shall be come effective immediately.

Section V. SPECIAL EDUCATION
500.05 STANDARD:
Local school boards shall approve Special Education programs for children of
0-21 years of age. These programs will be in keeping with P.L. 94-142 and other
applicable regulations.
500.05-1 STANDARD:
Local Education programs developed will provide services for those assessed as
having deaf, deaf blind, hard of hearing, orthopedically handicapped, other
health impaired, seriously emotionally disturbed, specific learning disable,
speech impaired, visually handicapped, mentally retardation or other learning
difficulties.
Section V. GIFTED AND TALENTED PROGRAMS
500-06 STANDARD:
Gifted and Talented programs developed shall provide differentiated educational
services beyond those normally provided by the regular school system. Counselors
will identify such students by testing and consultation with teachers.
Section V. COUNSELING RESOURCES
500-07 STANDARD:
The local school board will employ a minimum of (1) Counselor for grade K-8
students and (1) Counselor for grade 9-12 students, for each (150) maximum
students at each of the listed grade levels.
500-07-1 STANDARD:
Counseling personnel will be required to meet qualifications and preparation as
prescribed by the CODE, inclusive of Lakota language and Lakota Culture academic
preparation as prescribed by teaching personnel.
500.07-2 STANDARD:
The local school board will approve a counseling program for students in the
school system designed to accommodate individual and group counseling,
supportive training, specialized training, awareness activities, career
awareness, problem solving and other needs of students.
Section V. STUDENT EVALUATION
500.08 STANDARD:
The local school board will approve a student evaluation program designed to
provide for an effective evaluation of student performance and self-concept,
with such process to include:
(a) Standardized Testing
(b) System-developed Testing (to reflect system curriculum)
(c) Other (as identified by the local school system)
500.08-1 STANDARD:
The local school board will approve an identified process of reporting and recording student progress to students and parents on a minimum of a quarterly basis.
Section V. SCHOOL AGE/COMPULSORY SCHOOL ATTENDANCE
500.09 STANDARD:
Students are required to be enrolled in school upon the age of 6 years, providing that the age of 6 years is reached by September 1, of the ensuing school term. Students shall be enrolled in school until successful completion of a 12th grade course of study, or until reaching the age of 18 years.
500.09-1 STANDARD:
KG students shall attain the age of 5 years by September 1, of the current
school term prior to enrollment in a KG program; Grade one students shall attain
the age of 6 years by September 1, of the current school term prior to
enrollment in primary school (grade one).
500.09-2 STANDARD:
Students must adhere to the Oglala Sioux Tribal Compulsory Attendance Ordinance.
Students may not miss more than (3) days without school system follow-up,
consultation and counseling.
Section V. ENROLLMENT
500.10 STANDARD:
Health requirements shall be the same for all grades and shall comply with
Tribal and State Law. All entering students must have immunizations for
contagious diseases completed prior to enrollment.
500.10-1 STANDARD:
Schools will admit students providing all necessary documents for grade level
are in order and parent consent is provided, in accordance to local school
policy.
Section V. ATTENDANCE AREA
500.11 STANDARD:
The local school board shall establish legal boundaries of attendance and
enrollment in the school system, and disseminate such boundaries to residents of
the attendance area.
500.11-1 STANDARD:
The local school administrators will disseminate information to students,
parents and personnel concerning the legal boundaries of the school campus,
specifying those areas which are under the authority of school officials.
Section V. UNIT OF CREDIT
500.12 STANDARD:
A unit of credit shall be defined as participation in a minimum of 200 minutes
per week for a school term for 9-12 students nonlab courses and a minimum of 250
minutes per week for lab courses.
Section V. GRADUATION REQUIREMENTS
500.13 STANDARD:
Graduation requirements for secondary students shall consist of a minimum of 18
units of credit in those areas as identified in the CODE. (500.05-2)
500.13-1 STANDARD:
Graduation requirements for students in grade eight shall consist of completion
of a minimum of 12 units of credit in those areas as identified in the CODE
(500.04)
500.13-2 STANDARD:
Required courses for graduation from grade 8 and grade 12 shall be as identified
in the CODE. (STANDARD 500.05-2)
500.13-3 STANDARD:
Local school boards .shall determine if a transfer student may graduate from the
local school system.
Section V. TRANSFER STUDENTS
500.14 STANDARD:
Students transfers may be made by authorization of the parent or legal guardian.
500.14-1 STANDARD:
The local school board may make a disciplinary transfer in lieu of suspension or
expulsion.
500.14-2 STANDARD:
Students transcripts must accompany student when a transfer occurs.
Section V. EDUCATIONAL SUPPORT PROGRAMS
500.15 STANDARD:
The local School Policy will provide for support service personnel who meet
position requirements as established by the accrediting agency, and the local
school board.
500.15-1 STANDARD:
The local school board will provide for the availability, utilization and
maintenance of safe transportation equipment for student transportation
services, and will develop, implement and monitor policy reflective of the
inspection, maintenance, and utilization of all student transportation service
vehicles.
500.15-2 STANDARD:
The local school board will provide for the development, implementation and
monitoring of the school food service program for students, with such program to
meet food preparation, storage serving, sanitation, nutrition and menu
requirements as established by the Child and Adult Nutrition Program or other
monitoring agency, and the requirements as established by the local school
board, inclusive of Department of Health inspections and other monitoring entity
expectations.
Section V. HEALTH PROGRAM
500.16 STANDARD:
The local School Policy will provide for a School Nurse who possesses those
qualifications as prescribed by this CODE or other accrediting agency, and those
qualifications as prescribed by the local school board. (SECTION IX)
500.16-1 STANDARD:
The local school board will provide for the implementation of a Health Program
for the school system which is designed monitor immunizations and skin tests,
provide for physical examinations, conduct daily medical care for those
requiring services, and to implement learning activities in the classroom, with
such activities to include personal hygiene, personal development, health care
and other such activities. (South Dakota Codified Laws)
Section V. ALCOHOL/DRUG ABUSE
500.17 STANDARD:
The local school board will approve policies regarding the use, distribution,
possession and abuse of alcohol or other drugs by students.
500.17-1 STANDARD:
The local school board will approve implementation of learning activities
concerning alcohol/drug abuse for each grade level.
500.17-2 STANDARD:
The local school board will approve an alcohol/drug abuse awareness program for
students in the school system.
Section V. FREE ENTERPRISE
500.18 STANDARD:
The local school board will approve policy and programs which provide for the
incorporation of learning activities in the area of Free Enterprise for
students.
Section V. CURRICULUM DEVELOPMENT
500.19 STANDARD:
The local school board will approve the development, documentation
implementation and monitoring of a local school system Curriculum Guide, with
such guide to include:
(a) Educational activities designed to provide for the cultural, social,
emotional, physical, mental, professional and creative development of students.
(b) Activities which are reflective of, integrate learning in and awareness of
the Lakota society and other societies and cultures.
(c) Development which incorporates those priorities as established in the School
Philosophy, and the Student Outcomes as developed by the local school system.
(d) A process for evaluating the development of students in skills, self-concept
and other areas of development as prescribed by the second curriculum.
500.19-1 STANDARD:
The local school board will approve a process of monitoring the implementation
of identified curriculum activities by teachers..
500.19-2 STANDARD:
The local school board will approve the development and implementation of a
policy for educational personnel participation in the development of curriculum
for the local school system.
500.19-3 STANDARD:
Each school board shall, in consultation with administrators, develop a Lakota
culture program to be incorporated in each regular daily instruction, with a
minimum of 200 minutes of instruction to be provided in the areas of Lakota
Language or Lakota Culture to be provided to all students weekly.
Section V. LIBRARY/MEDIA RESOURCES
500.20 STANDARD:
The local school board will provide for the acquisition of a full-time
Librarian, with such personnel meeting those qualifications as required by
Tribal and State Regulations.
500.20-1 STANDARD:
The local school board will provide for adequate Library/Media Center resources
and equipment to enhance student learning activities.
500.20-2 STANDARD:
The local school board will provide for the development and implementation of a
Library/Media Center program incorporating specific activities to meet
identified learning outcomes for students in the area of Library/Media Center
resources.
500.20-3 STANDARD:
The local school board will provide for adequate facilities for location of the
Library/Media program and material resources, with facilities to include
instructional areas.
Section V. INSTRUCTOR AREA OR PREPARATION
500.21 STANDARD:
Teachers will be assigned to only those teaching areas for which they have
completed adequate preparation, as specified in the CODE. (Section IX)

The local school board will approve a K-12 Career Awareness/Career Education
program to provide students with an awareness of alternative vocations, and

interests and other areas as assessed by the local school board, with such
program identifying testing instruments, timelines, philosophy and reporting of
results.

The local school board will develop policy concerning the utilization and
reporting of student testing results, and also develop a process for the
utilization of student testing results as a basis for system evaluation, program
development, planning and resources.

600.10 STANDARD:
The local school board will develop arid implement a student activity program
designed to allow students the opportunity to learn new skills, provide a
creative outlet, "showcase" special skills and abilities, improve
self-concept, and have the opportunity for expression, with such program being
developed and implemented in an equitable manner with respect to grade level,
gender, interest areas and other identified elements.

The local school board will provide for the trained, competent and qualified
personnel required to provide for effective supervision of students
participating in activity program activities.
600.10-2 STANDARD:
The local school board will provide for the development and implementation of a
"showcasing" opportunities for students designed to allow them the
opportunity to demonstrate special skills, talents or abilities, and those
equipment, facility and materials resources required for the implementation of
an effective activities program.
Section VI STUDENT ATTENDANCE
600.11 STANDARD:
The local school board will establish a system of the daily reporting and
documentation of attendance at school for all students enrolled in the school
system each year.
600.11-1 STANDARD:
The local school board will establish attendance policies for students in the
school system, with such policies listing expectations, limitations as to
non-attendance, promotion and retention based on attendance criteria, processes
for reporting student attendance and non-attendance to parents on a regular and
consistent basis, alternative processes and procedures for chronic
non-attendance, and other appropriate policies and procedures for student
attendance.
600.11-2 STANDARD:
The local school board will provide policy governing the implementation of
motivational and acknowledgement activities to promote student attendance at
school on a regular basis.

The local school board will develop policy and provide supportive program
resources designed to increase student daily attendance and provide for the
active involvement of staff, students and parents to prevent student dropping
out of school.

The local school board will establish policy providing for the regular and
consistent acknowledgement of student achievement and performance during the
school year.

The local school board will establish, implement and monitor student activity
eligibility requirements of the local school system, with such standards meeting
those standards as required by the SDHAA or other activity association in which
the local school system participates, and those standards and requirements as
established by the local school board.

procedures for grievances relating to student activity eligibility for the local
school system and students.

The local school board will develop policy which identifies dissemination

provide for timely dissemination of information concerning events and activities

The local school board will provide for the acquisition and availability of

The Oglala Sioux Tribe does hereby establish five (5) day school week for all elementary and secondary schools operating within the exterior boundaries of the Pine Ridge Indian Reservation and become effective immediately.
