ORDINANCE NUMBER 81-1 |
SECTION 1: PURPOSE AND AUTHORITY.
The purpose of this ordinance is to establish the criteria by which members of other federally-recognized Indian tribes shall be declared to have "close social and economic ties" with the Confederated Tribes of Siletz Indians of Oregon for purposes of eligibility for Indian Health Contract Services (with approval and certification to be made by the Indian Health Service). The authority for adoption of this ordinance is Article IV, Section 1 of the Siletz Constitution, adopted June 2, 1979, and approved by the Secretary of the Interior on June 13, 1979.
Those persons who are members of federally-recognized Indian tribes and who are full-time employees of the Confederated Tribes of Siletz Indians of Oregon are declared to have established close social and economic ties with the Tribe.
Those persons who are members of federally-recognized Indian tribes, who are not full-time tribal employees, and who believe that they have a relationship with the Tribe that constitutes "close social and economic ties" shall make a request to the Tribal Council that they be declared to have close social arid economic ties with the Tribe. The request shall be in writing and shall state supporting reasons.
The Tribal Council shall decide such requests on a case by case basis. The Council shall have discretion to approve or deny any request upon application of its rules and standards. The Tribal Council may consider any factors it deems relevant to its determination.
SECTION 4: APPEALS.
Parties whose requests are denied may appeal to the Tribal Court under the Rules
of Appellate Procedure of this Code.
