PARENTAL RESPONSIBILITY ORDINANCE

Siletz Tribal Code §15.100

§15.100 PURPOSE AND AUTHORITY: The Siletz Tribal Council is concerned with the proliferation of illegal activity by minors in violation of Siletz Tribal Code and Oregon Criminal Statutes; the Tribal Council recognizes that parents of minors should be encouraged to exercise supervision and care of their children, so that such illegal activity will be reduced or eliminated; therefore, the purpose of this ordinance is to create the civil offense of Failing to Supervise a Minor.


§15.101 OFFENSE:
A person commits the offense of Failing to Supervise a Minor if: the person is the parent, legal guardian or person with legal responsibility for the safety and welfare of a child under 18 years of age and the child has been found in violation of any provision of the Siletz Tribal Civil Offense Ordinance.


§15.102 DEFENSE
: It shall be a defense to the civil offense of Failure to Supervise a Minor if:

(a) The parent, legal guardian or person with legal responsibility for the safety and welfare of a child, upon discovering the child's act, promptly reported it to the appropriate authorities.

(b) The parent, legal guardian or person with legal responsibility for the safety and welfare of a child, upon discovering the child's act, promptly reported it to the appropriate authorities.


§15.103
RESTITUTION: In addition to any fine or penalty imposed pursuant to this ordinance, the court may order the parent, legal guardian or person with legal responsibility to pay any restitution to a victim of the minor's conduct. The amount of restitution ordered pursuant to this ordinance shall not exceed $2,500.00.


§15.104
FIRST OFFENSE: The first time a person is convicted of the civil violation of Failure to Supervise a Minor, the person shall not be required to pay a fine exceeding $100.00 if the person enters a service agreement with the Tribe. The court may waive all such fines if a first time offender agrees to participate in a parenting program, but only if such program is offered and available through the Tribe at the time of the sentencing.


§15.105 EXCEPTION TO PARENT, GUARDIAN OR PERSON WITH LEGAL RESPONSIBILITY:
The Confederated Tribes of Siletz Indians of Oregon is exempt from any liability imposed by this ordinance for any children who are Youths in Need of Care or are otherwise under the custody, care, control or direction of the Confederated Tribes of Siletz Indians of Oregon.


CERTIFICATION
The foregoing ordinance was amended by the Siletz Tribal Council at a Regular Council meeting held on January 18, 1997, at which a quorum was present, and the ordinance was amended by a vote of 9 FOR, 0 AGAINST, and 0 ABSTAINING.
